Terms and Conditions
The terms on which you may use HyperNoesis — your responsibilities, our obligations, billing, and the limits of the service.
Draft — not yet legally reviewed. These terms were prepared from how the service actually operates, but they have not been reviewed by a qualified lawyer. Have them reviewed before relying on them.
Last updated: 26 October 2026
By using HyperNoesis you agree to these terms. If you do not agree, do not use the service.
The service
HyperNoesis provides AI-assisted applications: chat, agents, image generation, question-answering over documents you upload, text-to-speech, and real-time voice. Responses are produced by third-party AI models.
Your account
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be old enough to form a binding contract where you live.
An anonymous account may be created automatically so the applications work before you sign up. It is tied to your browser and may be lost if you clear your browser data.
Acceptable use
You may not use HyperNoesis to:
- break the law, or infringe anyone's rights
- generate material that sexually exploits children, incites violence, or harasses people
- attempt to extract credentials, bypass usage limits, or disrupt the service
- resell or redistribute the service's output as if it were your own product without adding meaningful value
- submit personal data about other people that you have no lawful basis to share
We may suspend or terminate accounts that breach these terms.
Your content
You keep ownership of what you upload. You grant us the licence needed to operate the service — storing your content, and transmitting it to the AI provider that produces your result.
You are responsible for having the right to upload what you upload.
AI output — read this carefully
AI models produce output that can be wrong, biased, outdated or fabricated, including output that sounds authoritative. Do not rely on it for legal, medical, financial or other professional decisions without independent verification by a qualified person.
Output is not guaranteed to be unique; another user may receive something similar. We make no warranty that output is free of third-party rights.
Credits, billing and refunds
Usage is metered in credits. Free accounts receive a starting balance. Paid plans add a monthly credit allowance that resets each billing period and does not roll over; separately purchased credits are not reset.
Subscriptions renew automatically until cancelled. Cancel at any time from Settings → Billing; access continues until the end of the paid period, except for hosted servers, which carry a notice period (see below). Payments are handled by Stripe.
Statutory rights to a refund are unaffected. Beyond those, credits already consumed are not refundable.
Hosted servers
The Noë Bot, OpenClaw and Hermes add-ons rent a dedicated server for you by the month. We rent that server from a hosting provider on a monthly contract with a four-week cancellation notice, and the same notice applies to these add-ons:
- Cancelling. Cancel from Settings → Billing at any time. The subscription ends at the end of the billing period that contains the 28th day after your cancellation; that last period is charged in full. The end date is shown on the instance page, and the server stays yours until then.
- Failed payments. If a renewal payment fails, Stripe retries it. After the second failed attempt the server is scheduled to stop at the end of its current paid month, and the instance is removed when the subscription ends.
- Your data. When the subscription ends, or the server's rental term with the hosting provider ends without being renewed, the instance stops and everything stored on it is deleted. A new deployment starts from scratch: your data does not carry over, so keep your own copies of anything you need.
We also update the software on these servers automatically. Automatic updates cannot be turned off, and they work as follows:
- When a server updates. A server switches to a new version only when it is not busy, meaning no conversation or task has run through it recently. A Hermes or OpenClaw server that uses your own API key is updated only at night, between 03:00 and 05:00 in your time zone, because we cannot see when it is busy.
- One server first. A new version may reach one server before the others, so that a problem can be caught early.
- Servers that are always busy. If a server has been waiting 14 days for an update because it is always busy, it is updated at night, between 03:00 and 05:00 your time. A notice on the instance page tells you 2 days before.
- Updating straight away. You can always apply a waiting update at once with the Update button on the instance page.
- If an update fails. If a new version does not start correctly, the server automatically returns to the version it ran before.
Availability
We aim to keep the service running but do not guarantee uninterrupted availability. We may change, suspend or discontinue features, and will give reasonable notice of material changes where we can.
Liability
To the extent the law allows, HyperNoesis is provided "as is", and we are not liable for indirect or consequential loss, lost profits, or lost data. Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.
Termination
You may delete your account at any time from Settings → General, which deletes your content. We may terminate for material breach of these terms.
Changes
We may update these terms. Material changes will be signalled by the date above and, where they affect you meaningfully, notice in the application.
